Is Detective Agency Business Legal in India?

Yes. Running a private detective agency is legal in India, but investigators must operate within strict limits relating to privacy, surveillance, data collection and criminal law.

A missing employee, a doubtful business partner or a suspicious insurance claim can create questions that ordinary online searches cannot answer. This is where private detective agencies offer services such as background verification, fraud investigation and corporate due diligence.

However, a private detective is not a police officer. Opening an agency does not give anyone the authority to intercept calls, enter private property, access confidential government records or secretly hack a person’s phone.

Legal Status of Detective Agencies in India

India currently has no enacted central law dedicated exclusively to licensing private detective agencies. The Private Detective Agencies (Regulation) Bill, 2007 proposed mandatory licences and regulatory boards, but it was withdrawn from the Rajya Sabha in March 2020.

This does not mean the industry is completely unregulated. Detective agencies must comply with criminal law, information-technology law, privacy requirements, consumer-protection rules and applicable state or local regulations.

Services a Detective Agency Can Legally Offer

A detective agency may provide lawful services such as:

  • Employee background verification
  • Pre-matrimonial background checks
  • Corporate fraud investigation
  • Business-partner verification
  • Insurance-claim investigation
  • Intellectual-property infringement checks
  • Address and identity verification
  • Missing-person searches
  • Workplace misconduct investigation
  • Public-record and social-media research
  • Asset searches using legally available information

Each investigation should have a legitimate purpose. The agency should obtain a written engagement letter explaining the client’s identity, reason for investigation, permitted methods and intended use of the report.

Registrations and Licences Required

Although there is no standard central detective licence, an agency may require ordinary business registrations, including:

  • Registration as a proprietorship, partnership, LLP or company
  • PAN and a business bank account
  • GST registration when applicable
  • Shops and Establishments registration
  • Municipal trade licence, where required
  • Professional tax registration in applicable states
  • Employee-related registrations when the workforce crosses prescribed limits

Local police or state-specific requirements should also be checked before operations begin.

If the agency supplies security guards, bodyguards or security personnel, it may require a licence under the Private Security Agencies (Regulation) Act, 2005. A detective business registration cannot replace a private-security licence.

Activities a Private Detective Cannot Perform

A private detective cannot exercise police powers. Investigators have no special right to arrest, detain, search or interrogate anyone.

An agency should never:

  • Hack phones, computers, emails or social-media accounts
  • Obtain call-detail records through bribery or false documents
  • Intercept telephone calls or private messages
  • Install spyware or access passwords without permission
  • Enter a house, office or private property without consent
  • Place hidden cameras in bedrooms, bathrooms or changing rooms
  • Impersonate a police officer or government official
  • Threaten, blackmail or physically intimidate a person
  • Steal documents or confidential business information
  • Plant evidence or create a false investigation report

The Information Technology Act, 2000 contains provisions concerning unauthorised computer access, identity theft, digital personation and violation of privacy.

Is Physical Surveillance Legal?

Observation from a lawful public place may be permissible when connected to a legitimate investigation. However, surveillance must not become harassment, stalking or an invasion of private space.

Repeatedly following a woman or monitoring her electronic communications despite clear disinterest may attract the stalking provisions of the Bharatiya Nyaya Sanhita, 2023. Voyeurism and criminal trespass are also punishable offences.

A client’s request does not make an illegal surveillance method lawful. An agency should refuse assignments motivated by revenge, harassment, political intimidation or domestic abuse.

Handling Personal and Confidential Data

Investigation reports can contain addresses, photographs, employment records, family details and financial information. Agencies should collect only information relevant to the assignment.

Files must be securely stored and shared only with the authorised client. Employees should sign confidentiality agreements. The agency should also establish a retention policy for deleting records after the purpose of the investigation is completed.

Selling personal information or publishing investigation photographs without justification can expose the agency to civil and criminal liability.

Maintaining Proper Investigation Records

Every case file should contain:

  • Client identity and contact information
  • Written authorisation
  • Purpose and scope of investigation
  • Agreed fees and refund terms
  • Dates and methods of information collection
  • Sources of important findings
  • Expenses and payment records
  • Final report delivered to the client

Reports should separate verified facts from assumptions. A detective must not guarantee that a spouse is unfaithful, an employee is dishonest or a suspect will be convicted.
